I write to seek formal confirmation of the safety governance, regulatory compliance, and risk management framework underpinning the deployment of roadside oral-fluid drug testing devices within this State.

This notice is issued in the public interest to ensure that compulsory biological sampling conducted under transport legislation is supported by a lawful, transparent, and evidence-based safety regime.

The matters requiring confirmation are set out below.

  1. Risk Assessments and Hazard Management
    Please confirm whether, prior to procurement and deployment of the current oral-fluid drug testing device/s:

• A formal chemical risk assessment was conducted;
• A hazard register was created and maintained;
• Exposure-risk modelling was undertaken (including mucosal exposure and inhalation risk);
• A disposal and contamination protocol was established;
• Ampoule breakage or leakage scenarios were assessed.

  1. Safety Data Sheets and Chemical Classification
    Please confirm:

• That current Safety Data Sheets (SDS) exist for all reagents contained within the device;
• That those SDS are compliant with Australian Work Health and Safety (WHS) Regulations and the Globally Harmonised System (GHS);
• The chemical classification of all reagent components;
• Whether the chemicals are scheduled, regulated, or subject to notification requirements under relevant Commonwealth or State chemical safety legislation.

  1. Work Health and Safety Compliance
    Please confirm:

• That a WHS risk assessment was completed under the applicable Work Health and Safety Act;
• That Safe Work Australia guidance (or State equivalent) was considered;
• That officer exposure risk (dermal, ocular, inhalational) was assessed;
• That procedures exist for chemical exposure incidents.

  1. Independent Verification and Currency
    Please confirm:

• The date of the most recent toxicological or chemical safety evaluation of the device;
• Whether independent laboratory validation was obtained;
• Whether safety testing post-dates the most recent legislative amendments authorising roadside oral sampling;
• Whether any jurisdiction-specific safety assessment was undertaken for use within this State.

  1. Training and Operational Manuals
    Please confirm whether operational training materials include:

• Chemical hazard information;
• Reference to SDS;
• Contamination and spill procedures;
• Disposal requirements for used devices;
• Incident reporting requirements for exposure events.

  1. Regulatory Oversight
    Please confirm whether any of the following were involved in pre-deployment review:

• The relevant Work Health and Safety regulator;
• The State health authority;
• An independent chemical safety assessor.

If such documentation exists, please identify the title and date of each document. If it does not exist, please confirm that fact.

This notice does not question the objective of deterring drug-impaired driving. Rather, it seeks assurance that compulsory roadside biological testing is implemented in a manner that is:

• Scientifically grounded;
• Chemically safe;
• Legally compliant;
• Transparent to the public;
• Supported by current and independent safety evidence.

However, before placing any device into my mouth, I respectfully request confirmation of the following:

  1. That the device does not introduce any chemical reagents, buffer solutions, preservatives, indicators, or other substances into my body;
  2. That current Safety Data Sheets (SDS) exist for any chemical components contained within the device;
  3. That the device has undergone a current risk assessment under applicable Work Health and Safety legislation;
  4. That there is no known risk of mucosal irritation, allergic reaction, chemical exposure, or ampoule leakage associated with its use.

If the device contains chemical reagents that come into contact with the mouth, I request confirmation that:

• The chemicals are classified as safe for mucosal exposure;
• They are compliant with Australian WHS and chemical safety standards;
• There are established procedures in place for exposure or contamination incidents.

If such confirmation cannot be provided at the roadside, I respectfully state that I have concerns about introducing unidentified chemical substances into my body without disclosure.

I remain willing to comply with any lawful alternative method of providing a saliva sample that does not involve exposure to undisclosed chemical reagents.

This notice is not a refusal. It is a request for safety clarification before submitting to chemical contact.

If you determine that I am legally required to comply regardless of disclosure, I request that you clearly state that direction and the legislative authority you rely upon, so that I may comply under protest and preserve my rights.

Important Practical Reality (You Should Know)

In most Australian states:

  • Driver refusal to provide an oral fluid sample when lawfully required is an offence.
  • Officers are not required to provide SDS at the roadside.
  • “Conditional compliance” may still be treated as refusal if it delays or frustrates testing.
  • Religious or sovereignty-based arguments are routinely rejected by courts.

The strongest protective mechanism is:

  • Clearly state willingness to comply.
  • Ask the officer to confirm legislative authority.
  • If directed, comply under protest.
  • Challenge legality later through proper legal channels.

 

 

Earlier in 2025
Below is a draft notice you could issue to the officer or relevant agency (such as the police department or road traffic authority), stating your objection to self-administering unknown substances while affirming your willingness to provide a saliva sample under alternative conditions that do not involve introducing unidentified chemicals into your body.

Edit and use as you wish, this is just a starting point. Please research the chemicals on the equipment. Once your saliva touches the chemicals there is a chemical reaction, which is ONLY possible if chemicals are present.

We would suggest you send a notice to the road safety commission in your state and request the relevant information from them (ingredients lists, safety data sheets for all ingredients, coatings, packaging etc.
